Judge on MC, Bung’s corruption trial adjourned to May 9

The sessions court has now fixed four additional trial dates to decide on whether information from an unidentified source can be admitted.

The sessions court hearing the corruption trial of former Felcra chairman Bung Moktar Radin and his wife, Zizie Izette Abdul Samad, has adjourned to May 9 a ruling on the admissibility of information obtained from an unidentified source.

This is because trial judge Rozina Ayob is on medical leave for the entire week, according to deputy public prosecutor Law Chin How.

The case was mentioned before another sessions court judge, Azura Alwi, today.

Rozina was scheduled to deliver the ruling today, following which the trial was scheduled to continue with the last prosecution witness, investigating officer Haris Ibrahim.

The court has now fixed four additional trial dates — on May 9, 10, 17 and 18.

Bung and Zizie, represented by M Athimulan and K Kumaraendran respectively, were present in court.

On April 12, the defence raised an objection when the prosecution attempted to introduce information that it said could prejudice both the accused.

Kumaraendran said the information that was to be entered through Haris was hearsay evidence and inadmissible.

Athimulan said the information was inadmissible as it must be made by the complainant and that the defence was unaware who the complainant was in the case of Bung and his wife.

Haris had earlier testified that on June 9, 2016, his superior, Zainuddin Hussein, from MACC’s special investigations unit in Putrajaya, called him to put in writing a complaint pertaining to this case.

Kumaraendran stood up to object when Law asked Haris whether he could verify the information.

Deputy public prosecutor Sophian Zakaria, who is appearing with Law, submitted that the MACC Act was a special legislation which allowed information to be obtained from whistleblowers.

“Whistleblowers are protected and the investigating officer cannot reveal or identify the person in his report,” he had said.

Rozina then instructed both parties to file written submissions for her to make a ruling.

Bung, 64, who is also Kinabatangan MP and Sabah deputy chief minister, is facing two charges of accepting bribes amounting to RM2.2 million and RM262,500 as an inducement to obtain Felcra’s approval to invest in the Public Mutual unit trust fund.

The non-executive chairman of Felcra at the time, he is accused of accepting the bribe through Zizie at Public Bank’s Taman Melawati branch here between 12.30pm and 5pm on June 12, 2015.

He also pleaded not guilty to accepting RM335,500 in cash as a bribe from unit trust consultant Norhaili Ahmad Mokhtar, through Zizie, for the same reason and at the same place on June 19, 2015.

Zizie, 44, pleaded not guilty to three charges of abetting her husband in the matter at the same place, date and time.
