Houseowners will be compensated for late delivery, pledges developer

Property developer Country Garden Danga Bay has promised to compensate houseowners for late delivery of vacant possession.

This follows the Federal Court’s dismissal of its motion for leave to appeal against damages or compensation awarded to seven buyers for late delivery of their service apartments.

“Country Garden Danga Bay has always respected the interests of houseowners and has continued to strive to provide better services to the residents as well as surrounding communities,” the Edge Markets quoted the developer as saying in a statement.

The vacant possession was delivered after more than four years from the originally scheduled delivery date.

In July last year, the Court of Appeal dismissed the developer’s appeal for a judicial review against the earlier decision of the Kuala Lumpur High Court and Tribunal of Home Buyers Claims to award damages to the seven buyers.

Country Garden Danga Bay stated that it was backed by its parent company, Country Garden Holdings, and confirmed that the company’s financial status remained strong.

“During the pandemic, the company observed certain rules and regulations in order to curb the spread of Covid-19 infections with the intention to protect our staff,” it said.

As such, it said, it had “limited” its physical presence and manpower.

It said it would mobilise manpower in phases to undertake overdue property maintenance work as Malaysia transitioned to the endemic phase.
