Cop jailed for causing grievous hurt freed on bail pending appeal

The High Court allows application by the lance-corporal since there was no objection from the prosecution.

PETALING JAYA:
A policeman who was convicted last month for causing grievous hurt to a labourer had his jail term suspended pending the outcome of his appeal.

Judicial commissioner Azhar Abdul Hamid allowed lance-corporal Baxter Kisar’s stay of execution application since there was no objection by deputy public prosecutor Kamarul Aris Kamalluddin.

Azhar imposed a RM20,000 bail in one surety and ordered Baxter’s passport to be impounded and the policeman to report to the nearest police station once a month.

Guok Ngek Seong, who represented Baxter, said his client had been in Kajang Prison for 17 days after a sessions court sentenced him to 10 years’ jail and fined him RM10,000, in default six months’ jail.

On March 28, Judge Mahyon Talib meted out the sentence after finding that the defence had failed to raise reasonable doubt on the prosecution’s case.

She also ordered Baxter, 32, to start his jail term on the same day.

Baxter was accused of committing the offence against A Krishnan, 38, in front of a food outlet in Jalan Rampai Niaga, Sri Rampai, Wangsa Maju, here on July 18, 2017. He was charged under Section 307 of the Penal Code, which carries a maximum 20 years’ imprisonment and a fine.

Guok told FMT that a case management will be held on May 31 to determine Baxter’s appeal hearing date.
