MMTA president, partner refused leave to appeal in S’pore

RM1.6 million judgment in favour of Ice Messaging stands, rules the High Court's appellate division.

Malaysian Mobile Technology Association (MMTA) president Shawn Ng Chee Heung and his business partner suffered a significant defeat in the Singapore High Court yesterday after its appellate division rejected their application for leave to appeal to the republic’s court of appeal.

Ng, 48, and Jerald Wong Thai Hian, 42, who own Cookiss Mobile, were seeking to overturn a Singapore High Court judgment delivered on Jan 28 which ordered them to repay Ice Messaging Pte Ltd a combined sum of S$308,484 (about RM956,300).

Yesterday’s decision, handed down by Justices Quentin Loh and See Kee Oon, was communicated via a letter issued by the court to the parties’ respective solicitors.

In the court’s minute sheet sighted by FMT, Loh and See recorded their disagreement with Ng and Wong’s contention that Justice Lai Siu Chui had made six prima facie errors in her decision.

“There were no obvious prima facie errors as contended,” the judges noted when dismissing the application after considering written submissions filed by the parties’ solicitors.

They said that Lai was entitled to rule in Ice Messaging’s favour based on the evidence before her.

Six weeks ago, Lai had ruled that Ng and Wong were not entitled to the money which they received and that the payments had been procured by them illicitly.

Apart from the judgment sum, Ng and Wong were made liable for interest at 5.33% per annum from Feb 2, 2018 and legal costs of S$163,000 (RM505,300).
