Prosecution can still review 15-year-old’s murder charge, says AGC

This is in light of recent developments including the outcome of an investigation into a rape incident involving the minor.

The Attorney-General’s Chambers (AGC) said today that it was not too late to review the murder charge against a 15-year-old girl who allegedly killed her newborn baby.

In a statement today, the AGC said that it can still revise the decision to charge the teenager for murder under Section 302 of the Penal Code based on new information.

“The prosecution can still assess and review the charge for murder made under Section 302 and revise it accordingly, taking into account recent developments including the results of an investigation done into a rape incident involving the teenager,” it said.

The AGC added that information on the rape was only discovered after the teenager was arrested and a police report was filed by the minor on Feb 8.

“Pursuant to the report, an investigation paper was opened and investigations are still under way.”

The AGC also said the child will be put through the court’s justice system in accordance with the Child Act 2001 and, if convicted, will be detained under Section 97(2) of the same Act.

The AGC’s statement comes after the 15-year-old girl was charged for the murder of a newborn baby boy in Kemaman, Terengganu.

The charge under Section 302 of the Penal Code was read out before magistrate Tengku Eliana Tuan Kamaruzaman on Tuesday.

The girl’s lawyer, Nurainie Haziqah Shafii, confirmed with FMT that a bail application was submitted but rejected by the court.
