
In dismissing the appeal by Syafiqah Izzati Badrul Hishamm, the three-man bench, chaired by Yaacob Md Sam, ruled that the High Court was correct to have the sentence served consecutively for 16 years as there were two separate victims.
The other judges were Ahmad Nasfy Yasin and Nordin Hassan.
The incident took place at Jalan Kencana, Taman Kencana Fasa 2, in Pandan Perdana, Ampang, Selangor on Jan 29, 2019.
Syafiqah had previously pleaded guilty in the sessions court to a charge of committing grievous hurt on her aunt Rafzaliza Rafli, 36, and Nadia Mohd Khalid, 38, a friend of her aunt.
Anyone convicted on the charge could be sentenced up to 20 years jail or fined or whipped. However, a woman offender is spared the caning.
The sessions court sentenced her to eight years each for both offences and ordered her jail term to run concurrently. The trial court also ordered the jail term to begin from Jan 30, 2019, the day she was arrested by police.
The prosecution then made a successful appeal to the High Court for the sentence to run consecutively instead.
The facts of the case revealed that she had a misunderstanding with her aunt over a debt that led to her splashing the corrosive substance.
Nadia, who was an innocent bystander, also became a victim due to Syafiqah’s rage. Both women suffered injuries on their bodies and their faces were also partly disfigured.
