
Judge Khatijah Idris, in allowing the application by the club and eight other office bearers, said it was improper for R Ragavan to get the order on Dec 17.
“He did not serve the cause papers on the defendants (club and officer bearers) before getting the injunction on an urgent basis,” she said.
Khatijah also instructed Ragavan to pay RM7,000 in costs to the club and ordered for an assessment of damages for restraining the AGM from being held on Dec 18.
The club, represented by lawyer A Srimurugan, was scheduled to hold an extraordinary general meeting (EGM) last year but it was shelved due to the movement control order (MCO) in place at the time.
Unhappy with the club’s decision, Ragavan and several others conducted an unsanctioned EGM which initially led to his suspension.
He then filed a suit that the postponement of the EGM and his suspension were wrong.
Ragavan, represented by Malcolm Fernandez and Cheng Sheng En, then filed for an interim injunction to stop the club from conducting its AGM.
This led the private social club to expel Ragavan for taking his grievances to the High Court and the Registrar of Societies (RoS) without exhausting all internal avenues.
