Judge orders case of assault at condo pool moved to High Court

PETALING JAYA:
The Ipoh magistrates’ court today ordered the case of a businessman, charged with the murder of a security guard at a condominium in December 2020, to be transferred to the High Court.

Magistrate Noor Azreen Liana Mohd Darus issued the order after allowing deputy public prosecutor Fatin Hosna Mohamad Zikri’s application to transfer the case involving Ahmad Noor Azhar Muhammad, 34, to the High Court.

Bernama reported that Ahmad was charged with killing S Thava Sagayam, 64, who was on duty at Menara Majestic at Jalan CM Yusuff, Ipoh, between 8am and 9.30am on Dec 29, 2020.

An earlier report had said that a guard was assaulted by a man after he stopped his son from using the swimming pool, which was closed to the public at the time.

The guard lost consciousness and died in August last year.

Ahmad is being charged under Section 302 of the Penal Code, which provides for the death penalty if convicted.

He had been charged in the Ipoh magistrates’ court earlier with causing grievous bodily harm to Thava, but the charge was amended after Thava died, with police reclassifying it as a murder case on Sept 9.
