BN man files petition to nullify Sungai Udang polls’ results, alleges bribery

Barisan Nasional candidate Mohamad Ali Mohamad, who lost the Sungai Udang seat in last month’s Melaka elections, has filed an election petition to nullify the victory of Perikatan Nasional’s Dr Mohd Aleef Yusof, claiming that there were elements of bribery.

Ali, who lost the seat by a 530-vote majority in a four-cornered fight, filed the petition on Dec 14 and wants the election court to declare that Aleef was not properly elected in the polls held on Nov 20.

He wants the result to be nullified and the court to make orders it deems fit, including costs.

Ali named Aleef, the Sungai Udang seat returning officer and the Election Commission as respondents to his petition.

Case management will be held in Melaka on Dec 30 for a court deputy registrar to give direction to all parties.

An election judge from outside Melaka will be appointed by the Chief Judge of Malaya to preside over the dispute.

Section 35A of the Election Offences Act states that all election challenges must be completed within six months after a petition is filed.

In his petition, Ali said deputy defence minister Ikmal Hisham Abdul Aziz, a former Umno member and BN MP for Tanah Merah (Kelantan), switched allegiance to Bersatu, now a coalition member of PN.

He said Aleef was previously a Hang Tuah Jaya Umno Youth committee member before he was nominated by Bersatu to contest the Sungai Udang seat.

“Aleef was never elected assemblyman and he depended on Ikmal to introduce him to voters in the constituency,” he said.

Ali claimed that Aleef had committed corrupt practice in connection with the elections with his knowledge or consent or by any of his agents, an offence under Section 32(c) of the Election Offences Act.

The court has power to declare the seat vacant if a candidate is found to have indulged in such practices.

Ali alleged that Aleef and/or Ikmal had presented gifts in cash or in other forms to alter the outcome of the election result in that constituency.

In the petition, sighted by FMT, he said a substantial number of army voters casted their ballots for Aleef instead of him because of the alleged bribery, which he would show proof of in court.

Aleef polled 6,789 votes, beating Ali (6,259), Hasmorni Tamby of Pakatan Harapan (2,035) and independent Mohd Zahar Hashim (471).

BN swept 21 out of the 28 constituencies in the elections, securing a two-thirds majority to form the new government.

PH only managed to win five seats, while PN won two.

Apart from Sungai Udang, PN secured the Bemban seat when its candidate, Dr Mohd Yadzil Yaakub, polled 4,211 votes to defeat BN’s Koh Chin Han (3,883).
