
Lawyer Rajesh Nagarajan, representing the family of Orhions Ewansiha Thomas, said they wanted the High Court to look into the coroner’s findings on the cause of death.
Thomas died at the Bukit Jalil detention centre in July 2019 after being arrested with 19 others during a raid at the Desa Aman Puri apartment in Kepong, Selangor.
The immigration department said he had experienced a seizure before his death and denied any foul play. This sparked a protest outside the Nigerian high commission.
An inquest was held to determine the cause of his death after his widow, Blessing Uhunoma Eriamiator, claimed following witness testimony that he was assaulted while in custody.
Last month, coroner Mahyon Talib ruled that Thomas died of a heart attack and that there was no negligence committed by the immigration officers.
The court also ruled out criminal elements over his death.
In their review application, filed on Nov 26, the family claimed that Mahyon had failed to consider that Thomas’ arrest for alleged breach of immigration laws was unlawful, and that he was not given medical assistance when he was unwell during his detention.
They also said the authorities did not release him immediately after they confirmed that his documents were valid.
High Court judicial commissioner Azhar Abdul Hamid fixed Feb 18 for case management of the family’s revision bid.
