This is based on the verdict currently being delivered by Court of Appeal judge Abdul Karim Abdul Jalil.
Karim said there is no reason to contradict trial judge Mohd Nazlan Mohd Ghazali. He said the claim that the money was an Arab donation is untenable.
Nazlan had sentenced the former prime minister to 10 years’ jail on each of the three counts of criminal breach of trust.
Najib, 68, was accused of misappropriating RM27 million and RM5 million in December 2014, and another RM10 million in February 2015 as a public servant and agent of the government, namely the prime minister, finance minister and SRC International adviser emeritus.
The funds were part of two loans from the Retirement Fund Inc (KWAP) to SRC worth a total of RM4 billion.
The charges were made under Section 409 of the Penal Code, which provides for a jail term of up to 20 years, whipping and a fine upon conviction.
