
This follows the decision of the prosecution and the babysitter, Noor Aqilah Abd Rahman, to withdraw their appeals on the sentence.
Lawyer Mohd Redzuan Mohamed Yusoff today told a three-member bench, chaired by Hanipah Farikullah, that his client, Noor Aqilah, had decided not to pursue the appeal to reduce the jail term.
Deputy public prosecutor Fauziah Daud told the bench, which included Abu Bakar Jais and Mariana Yahya, that she was also pulling back the appeal to enhance punishment.
Hanipah then struck out the appeals and affirmed the six-year imprisonment meted out by the High Court.
Noor Aqilah, 36, was charged under the Child Act with exposing Adam Rayqal Mohd Sufi Naeif to physical injury.
She was also accused of disposing of Adam’s body with the intention to conceal the death and shield herself from the offence.
Both offences were committed at her house at Jalan Nakhoda Kiri 3, Batu Caves, in Kuala Lumpur between 6.20pm and 6.50pm on July 3, 2018.
On Feb 14, 2019, Noor Aqilah was jailed for three years and six months after she pleaded guilty to the first offence. She was also fined RM5,000 and ordered to perform community service for 200 hours.
She also pleaded guilty to the second offence and was sentenced to 18 months’ jail and fined RM5,000.
However, the sessions court ordered the sentences to run concurrently, meaning she would only serve a jail term of three years and six months.
On appeal by the prosecution, the High Court on Aug 18, 2019 raised the jail term to six years and maintained the other forms of punishment.
The punishment for the second offence was left intact.
The High Court ordered both sentences to run concurrently, meaning Noor Aqilah will serve the six years from Feb 14, 2019.
Adam was reported missing on July 3, 2018 from the house of his babysitter in Batu Caves. Police found his body in the freezer of a refrigerator at the house late that night.
A post-mortem conducted at the Kuala Lumpur Hospital revealed that Adam had died from brain haemorrhage and had suffered a skull fracture.
