2 brothers to hang for drug trafficking

The Federal Court says the trial judge had properly considered the defence case before finding them guilty.

Two brothers will face the gallows after the Federal Court dismissed their appeals for drug trafficking eight years ago.

Judge Vernon Ong, who led a three-member bench, said the judges were not persuaded by the argument advanced by a lawyer that their appeal against conviction had merit.

The trial judge had also given proper consideration of the case presented by the defence, said Ong, who sat with Zaleha Yusof and Harmindar Singh Dhaliwal.

He said the bench was not convinced that there was suppression of evidence or non-calling of a prosecution witness and the non-production of closed-circuit television footage at the crime scene.

“In fact, there is direct evidence on the commission of the crime,” he said, adding that the conviction by the trial court was safe.

S Ramani Raxen, 38, and Devendran, 40, were found guilty of trafficking in 339.3gm of heroin and 140.4gm of monoacetylmorphine together with two others still at large at a petrol station on Jalan Semenyih, Kajang, at about 11.20am on June 20, 2013.

The High Court found them guilty on April 7, 2017 and the conviction was affirmed by the Court of Appeal in early 2019.

Counsel Afifuddin Ahmad Hafifi appeared for the brothers while deputy public prosecutor Ku Hayati Ku Haron prosecuted.
