Vernacular schools dispute — bid to remove statements disallowed

The three language-based interest groups have instructed their lawyer to file an appeal.

KOTA BHARU:
The High Court has dismissed today an application by three language-based interest groups to expunge several contentious paragraphs in a suit filed by a Muslim teachers group which is challenging the existence of vernacular schools in Malaysia.

Judicial commissioner Mohamad Abazafree Mohd Abbas said there is no merit in the application to remove the statements made by Ikatan Guru-Guru Muslim Malaysia president Mohd Azizee Hasan in an affidavit to support the suit.

The three groups which jointly made the application were the Chinese Language Council,  Tamil Language Association and the Confederation of Former Tamil School Pupils.

They said the paragraphs, if allowed to remain, would prejudice the mind of the judge.

Shaharudin Ali , who appeared for the plaintiff, said the judge also ordered all defendants to file affidavits in response to the suit by Oct 30.

Another case management will be held on Nov 28.

Meanwhile, lawyer Keshwinjit Singh, who appeared for the three groups, said he had instructions to file an appeal on today’s order.

Azizee, who filed the suit on behalf of his organisation in February, is challenging the constitutionality of Sections 17 and 28 of the Education Act.

He named the education minister and the government as defendants.

Others who have been made interveners are MCA and the United Chinese School Committees Association of Malaysia (Dong Zong).
