
At the same time, LHDN has given notice to the court that it intends to strike out Najib’s application.
The five officers had filed affidavits to recover the money in a civil recovery proceeding early last year.
Najib’s lawyer Wee Yeong Kang said the High Court has fixed Dec 7 to hear both applications.
Wee said Najib’s application was filed last week under Rule 47 of the Insolvency Rules 2017 as his client wanted to know in detail how the outstanding tax amount was calculated.
During a virtual case management before High Court deputy registrar Ida Rahayu Sharif today, LHDN revenue counsel Al-Hummidallah Idrus said the agency intends to annul the application to examine the officers.
Ida Rahayu instructed LHDN to file its papers by Oct 13 and fixed another case management on Nov 9.
LHDN filed a bankruptcy notice against Najib on Feb 4 to recover the money.
Last year, the High Court ruled that Najib had to pay LHDN RM1.69 billion, inclusive of additional tax and penalties for the assessment years from 2011 to 2017, after allowing the agency’s application to enter a summary judgment against him.
Early this month, the Court of Appeal affirmed the High Court ruling.
Najib has filed for a final appeal in the Federal Court.
