
Her lawyer Akberdin Abdul Kader said the wife of former prime minister Najib Razak has also filed a fresh application in the Court of Appeal to stay her trial scheduled to resume on Oct 4.
“We have filed a certificate of urgency to move the appellate court to hear the stay application as soon as possible,” he told FMT.
Judge Mohamed Zaini Mazlan said Sri Ram’s appointment under the Criminal Procedure Code by then attorney-general Tommy Thomas in August 2018 was valid.
He also accepted the alternative submission by the prosecution that the present Attorney-General Idrus Harun’s backdated appointment letter for Sri Ram, which was issued on May 21 this year, could cure any defect by Thomas.
“I am inclined to agree with the prosecution’s proposition that the public prosecutor being an authority empowered to appoint a person to exercise a function, is entitled to make Sri Ram’s appointment with retrospective effect as set out under Section 50 of the Interpretation Acts 1948/1967,” the judge said in his brief grounds.
The judge also dismissed a stay of proceeding, pending an appeal to the Court of Appeal.
Rosmah is charged with soliciting RM187.5 million from contractor Saidi Abang Samsudin in a solar panel project for Sarawak schools, as well as receiving RM6.5 million in cash from him.
It is alleged that the money was meant to help Saidi’s company, Jepak Holdings Sdn Bhd, to secure the RM1.25 billion project.
