In the application filed on Sept 1, the organisation wants the High Court to review the Alor Gajah district and land office’s refusal to implement a decision made by the previous Pakatan Harapan government two years ago.

In February last year, the PH administration under chief minister Adly Zahari collapsed and was replaced by the Perikatan Nasional government.

The organisation wants the land office decision to be quashed and the state executive council’s decision made on Oct 2, 2019 restored within 30 days of a court ruling.

It has named the chief minister and the Alor Gajah district and land administrator as respondents but has to first obtain leave from the court before the merits of the complaint can be heard.

Case management has been fixed on Sept 27 before a High Court senior assistant registrar.

Organisation chairman R Sethuraman Reddy, who filed an affidavit in support of the application, said the decision to reject the application was irrational and unreasonable and the authorities took into consideration irrelevant factors.

The state executive council under Adly had decided on Oct 15, 2019 to set up a building for the Hindus to perform their obligatory rights to discharge cremated ashes into the sea.

A 0.74ha plot at Telok Gong in Kuala Sungai Baru, Masjid Tanah, 35km from the city, had been allocated for the project.

On Oct 28 last year, the organisation submitted its application for the plot to the Alor Gajah land office, but was told two days later that the application was incomplete.

It submitted a second application on Nov 6 and was told it was being processed.

On May 19 this year, the land office wrote to the organisation informing them that the application for the plot of land had been rejected.

The association subsequently wrote twice to the land office and present chief minister Sulaiman Md Ali’s office but there was no reply.
