Oct 28 set for Guan Eng’s appeal for higher damages from Utusan

The Court of Appeal will hear a bid by Lim Guan Eng to get Utusan Melayu (Malaysia) Bhd and its ex-features’ editor Zulkifli Jalil to pay more in damages.

Former Penang chief minister Lim Guan Eng’s appeal for a higher amount of damages for defamation from a defunct publisher and its former features’ editor has been fixed for Oct 28.

Lim’s lawyer Alex Lim said the date was fixed following a case management before a Court of Appeal deputy registrar.

Earlier today, the lawyer informed a three-member bench chaired by Lee Swee Seng that his client had obtained leave from a High Court last month to proceed with the appeal against Utusan Melayu (Malaysia) Bhd and Zulkifli Jalil.

In 2019, Utusan Melayu was placed under creditors’ voluntary liquidation and the legal firm of Dennis Nik & Wong is now handling all its legal disputes.

Lim is appealing against the RM30,000 quantum of damages awarded to him after the defendants admitted liability.

On Sept 27, 2018, Utusan Melayu and Zulkifli agreed to settle their libel suit with Lim after a more than three-year-long legal wrangle.

In the consent judgment, the publication, through Zulkifli, tendered an apology to Lim in open court before High Court judge Rosilah Yop.

In November 2018, the judge awarded the damages plus costs of RM20,000 to Lim.

Lim filed the suit after an article was published on April 10, 2015 alleging that Penang’s wakaf land had come under the purview of the chief minister’s office.
