
His lawyer Wee Yeong Kang said the judgment was recorded before the SCIT on Aug 26.
“My client has agreed to pay a certain sum of money due as an additional assessment but not to the tune of RM13.16 million,” he told FMT today.
Following this, he said Nizar would withdraw his appeal filed in the Court of Appeal.
“We will file a notice of discontinuance before the next case management on Sept 9. The draft of the notice has been sent to LHDN for their approval,” he said.
He said during a case management proceeding on the appeal today, the Court of Appeal fixed Sept 9 for parties to update on the status of the notice.
In the proceeding which was conducted online, senior revenue counsel Muhammad Nabil Abdul Halim acted for LHDN.
On Aug 7 last year, Judicial Commissioner Julie Lack ordered Nizar to settle RM13.16 million in unpaid taxes from 2011 to 2017 in allowing LHDN’s application for a summary judgment.
Lack said there were no triable issues since the board’s claims against Nizar were not time barred.
She also said it was settled law that a person who owed taxes must first pay up before appealing to the SCIT.
Nizar filed a notice of appeal over the decision on Aug 11 last year.
On July 24, 2019, LHDN on behalf of the government filed the writ of summons claiming that Nizar owed RM13,159,821.94 in additional taxes imposed from 2011 to 2017.
