AG must be present to answer queries in Parliament, says Azalina

The deputy speaker says Idrus Harun must be around if asked to justify emergency ordinances drafted by his office.

Dewan Rakyat deputy speaker Azalina Othman Said today said the attorney-general (AG) should be made available to answer questions regarding the emergency laws in the parliamentary meeting next week.

Azalina said this would clear any doubts on potential conflict of interest on Idrus Harun’s conduct and also justify the rationale of the emergency ordinances drafted by his office.

In a statement, she said while it was the constitutional duty of the AG to act as chief legal adviser to the King, the government and the Cabinet, he should also advise the lower and upper house of Parliament.

While the AG was not legally required to speak in Parliament, she said, allowance should be made for him to answer in person and not through a “third party”, referring to the law minister.

Azalina also said that to hold the AG accountable to Parliament directly, the next AG should be ideally an MP, a move mooted by former prime minister Abdul Razak Hussein.

She said the AG should be present at all Cabinet meetings, not like the present “as and when” basis.

“There are concerns of having a political AG in Malaysia for his tenure in office is at the mercy of the PM and it is for this reason that any future government must look into delegating the political AG’s prosecution powers to the solicitor-general, who is independent and has prosecution expertise,” she said.

Azalina said a tribunal should be set up to ensure the security of the AG’s tenure in office, with such a provision in existence before 1963.

She also called for a Parliamentary Service Act to be introduced so that Parliament remains an independent and autonomous institution regardless of the government in power.

Azalina also proposed the setting up of more special select committees and funding for them. Their composition should comprise some of the 88 MPs who are not part of any committee presently.

She said she was making a public statement today because “no one up there cares” about what she has to say.

The Dewan Rakyat will meet from July 26 to 29 and on Aug 2. The Dewan Negara will also sit for three days from Aug 3. The Dewan Rakyat’s last sitting was on Dec 17.
