Anwar’s appeal to set aside sodomy conviction put off to Sept 9

Court allows adjournment by intervener Muhammad Shafee Abdullah due to 'difficulty during the ongoing extended lockdown'.

Anwar Ibrahim’s appeal against a High Court decision to strike out his suit over his conviction for sodomising a former aide has been rescheduled to Sept 9 as an intervener sought a postponement.

Lawyer Sarah Abishegam, appearing for intervener Muhammad Shafee Abdullah, said they sought the adjournment due to “difficulty during the ongoing extended lockdown.”

A virtual hearing had been scheduled for today.

Shafee, through his solicitors Shafee & Co, had earlier written to the Court of Appeal deputy registrar requesting for the postponement.

Court of Appeal deputy registrar Mohd Hairi Haron, today fixed Sept 9 after holding a virtual case management.

Lawyer J Leela said Anwar’s lead counsel Gopal Sri Ram and the government, which is the respondent, were prepared to make submissions.

Senior Federal Counsel S Narkunavathy represented the government.

The High Court had in 2017 struck out Anwar’s originating summons on grounds that the case did not have any cause of action and was an abuse of the court process.

The PKR president had filed the action claiming he had not received a fair trial in the appeal against his sodomy conviction.

Anwar claimed Shafee had received RM9.5 million from former prime minister Najib Razak to lead the prosecution team in the Court of Appeal and Federal Court beginning in 2013.

In early September 2018, Siti Rahayu Mohd Mumazaini, who served under former attorney-general Tommy Thomas, filed an affidavit to support Anwar’s appeal to revive his suit made against the government.

Siti Rahayu said the cheques were deposited into Shafee’s CIMB Bank account on Sept 13, 2013 and Feb 17, 2014.

The Court of Appeal dismissed Shafee’s application to expunge Siti Rahayu’s affidavit and to cross-examine her. However, the court allowed Shafee to be made a party in Anwar’s appeal.
