PETALING JAYA:
Sime Darby Energy Solutions Sdn Bhd (SDES) has filed two suits against a construction and engineering company to recover about RM1.8 million for uncompleted work.

Speaking to FMT, lawyer Vijay Velupillai who is representing SDES said the first suit amounting to RM1 million was filed in the Shah Alam High Court in 2018.

“This action is for back charges and the trial will be held over four days from Nov 15,” she said.

For the second suit filed in 2019, Vijay said SDES, formerly known as Sime Darby Offshore Engineering Sdn Bhd, had filed a claim for close to RM800,000.

“This is for variation order, additional back charges, surplus (overpayment for work not done) and final contractual sum.”

Vijay said a two-day hearing from Nov 24 had been fixed in the Shah Alam High Court for the second suit.

“Both suits will be heard before the same judge,” she added.

Last week, Alamrio Builders Sdn Bhd managing director M Murugu Subramaniam told FMT that he obtained a garnishing order in early April for a bank to release to them whatever amount available in the account of SDES.

However, he said they only secured RM250,000 from the bank two weeks ago.

He said it only appeared to be a pyrrhic victory after the hard-fought court battle since 2018.

Alamrio had secured two contracts worth about RM8 million in 2014 and 2015 from SDES.

Murugu said Alamrio completed the first contract but abandoned the second after partially completing the work due to non-payment.
