
Judge Collin Lawrence Sequerah fixed the date after both prosecution and defence agreed to submit on the application on that day.
Deputy public prosecutor Mohamad Mustafa P Kunyalam told the court the prosecution had received Najib’s latest application to secure information from former banker Tim Leissner’s mobile phone records and Malaysia’s settlement agreement with Goldman Sachs earlier this week.
“The prosecution needs two weeks to reply to that. And we hope that this application (on Goldman Sachs) can be heard together with the previous one (bid to obtain documents from Zeti’s family and Low’s companies),” he said.
Lawyer Muhammad Shafee Abdullah said the defence had no problem for both applications to be tried together.
To that, Sequerah ordered the prosecution and defence to file their replies and submissions before May 21.
Najib is seeking to compel the government to provide information on Leissner’s mobile phone and his work emails on the grounds that the information is important for his on-going 1MDB trial.
“I believe that it is highly likely the contents in Tim’s mobile phone will show communication between him, 1MDB officers and Jho Low, and that they could disclose evidence that I have no knowledge of the criminal scheme and could disclose which 1MDB officials Tim had paid bribes and kickbacks,” he said in his affidavit.
On the Goldman Sachs-Malaysia agreement, Najib contended the confidentiality clause in the agreement was illegal and against public policy.
Besides documents from Goldman Sachs and the settlement, Najib is seeking to compel the government to provide banking documents belonging to companies controlled by Low and Zeti’s family.
In July last year, finance minister Tengku Zafrul Aziz said Goldman Sachs would pay US$2.5 billion (RM10.26 billion) in cash and guarantee the return of at least US$1.4 billion (RM5.75 billion) which had been seized by the US government as part of the misappropriated 1MDB funds.
Opposition MPs such as Wong Chen had asked the government to disclose the settlement details.
