
Judge Collin Lawrence Sequerah fixed the date to hear oral submissions after meeting Najib’s lawyer, Muhammad Shafee Abdulah.
The prosecution was represented by deputy public prosecutor Mohamad Mustaffa P Kunyalam.
The former prime minister, who filed a discovery application earlier this week, wanted the government to provide banking documents belonging to companies controlled by Low Taek Jho and Zeti Akhtar Aziz’s family.
Mustaffa said the judge ordered the prosecution to reply to Najib’s application by April 26 .
If the need arises, Najib could reply to the prosecution’s affidavit by May 7.
“Both parties are to file written submissions simultaneously on May 17 and hearing is fixed for May 20,” Mustaffa said.
In his application, Najib also wanted an order that the prosecution, the Malaysian Anti-Corruption Commission, Bank Negara Malaysia or any other entities having custody, care or control to produce the documents in any form.
He also requested for the statement made by senior police officer R Rajagopal in relation to a forfeiture case between the prosecution and OBYU Holdings Sdn Bhd.
Najib wanted the court to exercise its power to call Rajagopal, Mohammad Zamri Zainul Abidin of MACC and Mohd Fuad Arshad of Bank Negara to be questioned by his lawyers.
He said the documents sought were relevant to enable the court to have a complete and holistic appreciation of all the material facts and evidence of the 1MDB case to arrive at a just and fair decision.
“In all probability, documents favourable to the defence of the applicant (Najib) have been omitted or suppressed from production, contrary to the law,” he said in his affidavit in support of the application sighted by FMT.
Najib is standing trial on 25 charges for abuse of power and money laundering over alleged 1MDB funds amounting to RM2.28 billion deposited into his AmBank accounts between February 2011 and December 2014.
The trial, which started on Aug 28, 2019, is still at the prosecution stage, with about 10 witnesses having given evidence. April 19 has been fixed as a tentative date for it to continue.
