Any MP claiming majority support can submit SDs to Agong, says Takiyuddin

The de facto law minister says this is part of democracy.

De facto law minister Takiyuddin Hassan today said there are no restrictions on politicians backing any MP with majority support to become the prime minister.

He said any MP could forward statutory declarations (SDs) to prove that one has the support of more than 112 MPs to the Yang di-Pertuan Agong.

“We acknowledge that this is part of democracy,” he said during Ministerial Question Time at the Dewan Rakyat.

However, Takiyuddin said Prime Minister Muhyiddin Yassin still has the majority support “as seen by the passing of Budget 2021 at the policy stage” last month.

He said Muhyiddin had the support of 114 MPs after Dr Mahathir Mohamad resigned from the post of prime minister on Feb 24.

“One hundred and fourteen is more than 112,” he said.

Takiyuddin also said opposition leader Anwar Ibrahim had met the King on Oct 13 but a statement from the Palace later stated he did not submit the list of MPs supporting him.

He was replying to Hassan Karim (PH-Pasir Gudang), who asked the prime minister to state when the 25 motions of no-confidence and two motions of confidence in him will be tabled, debated and voted in the Dewan Rakyat.

Takiyuddin said the government is open to the motions of no-confidence and confidence in the prime minister but, according to Standing Order 14 and 15, government matters will take priority.

He said the Federal Constitution does not provide clear procedures to determine whether a person has the trust and majority support of Parliament to become the prime minister.

“Therefore, the Yang di-Pertuan Agong has the prerogative to decide.”

He said the King could, through any suitable means, determine if an MP has majority support, including by accepting any document from MPs.

Last week, Perak menteri besar Ahmad Faizal Azumu was removed after he lost the confidence of the state assembly. Only 10 out of the 59 assemblymen had supported the motion of confidence in him.

Following that, opposition MPs urged Dewan Rakyat speaker Azhar Azizan Harun to table a motion of no-confidence against Muhyiddin.
