Brigadier-General Mohammed Feizol Anuar Ayob, 50, and Lieutenant-Colonel Che Ahmad Idris, 54, had been charged with five counts of bribery yesterday.
Today, Feizol was charged with an additional two counts, and Che Ahmad Idris with one additional count of bribery.
Feizol was said to have solicited a RM150,000 bribe from FEHM Entity Sdn Bhd managing director Elias Jemadi Tajudin as an inducement for him to help submit a letter of intent by the company to be a strategic partner and contractor for maintenance of intelligence equipment at the Defence Intelligence Division.
He was also charged with agreeing to accept the bribe.
Both offences were allegedly committed in September 2019 at a coffee shop in Setia Alam, Shah Alam, in his capacity as then military adviser to the defence minister.
Feizol had been charged with five counts of accepting a total of RM128,000 from Elias yesterday.
Che Ahmad was accused of accepting 4,500 British pounds (RM25,000) from Elias as gratification for him to propose the appointment of FEHM Entity Sdn Bhd through direct negotiation to carry out maintenance services at the Defence Intelligence Division and to provide support services for the strategic electronic warfare system (Prisma).
He was said to have committed the offence at Kompleks Induk Stride, Taman Bukit Mewah Fasa 9, Kajang, Selangor, on Nov 22, 2019 in his capacity as then head of the Strategic Cyber Warfare Branch.
Yesterday, Che Ahmad was slapped with five charges for soliciting and agreeing to accept over RM600,000 in bribes.
Both pleaded not guilty. Sessions Court judge Yang Zaimey Ghazali set bail of RM10,000 for Feizol and RM15,000 for Che Ahmad.
All charges were framed under Section 16(a)(B) of the Malaysian Anti Corruption Commission (MACC) Act 2009, and punishable under Section 24(1) of the same Act.
If found guilty, they face imprisonment of up to 20 years and a fine of not less than five times the amount of gratification sought, or RM10,000, whichever is higher.
Yesterday, alongside Feizol and Che Ahmad, former director-general of the Defence Intelligence Division, Lieutenant-General (Rtd) Sheikh Moksin Hassan, 59, was charged with soliciting and accepting gratification in connection with the awarding of the defence ministry’s projects to a company. He faces seven charges in total.
