Second bid by woman to be intervenor in Vell Paari’s suit

Court fixes Oct 8 to hear application by Meeriam Rosaline, who claims to be wife of former minister S Samy Vellu.

A woman claiming to be the wife of former MIC president S Samy Vellu has filed a new application to be an intervenor in S Vell Paari’s lawsuit to have his father’s mental health determined by the courts.

Lawyer RSN Rayer, representing Meeriam Rosaline Edward Paul, 59, said the application was filed on Sept 22.

“Previously, Rosaline’s application to be an intervenor in Vell Paari’s lawsuit was rejected by the court. So she filed a new application and the court has fixed Oct 8 to hear the application,” he told reporters after case management before deputy registrar Idamasliza Maarof in chambers today.

Also present was lawyer Tina Ann Francis, representing Vell Paari.

On Sept 11, High Court judge Wong Chee Lin rejected Rosaline’s first bid to be an intervenor in Vell Paari’s lawsuit and ordered her to pay cost of RM5,000 after hearing arguments from both parties.

The same day, the judge allowed an application by Vell Paari for his father to undergo mental health screening.

The application was made by Vell Paari in the suit he filed against Samy Vellu for the court to declare that his father was incapable of managing his own affairs.

Vell Paari, 58, filed the suit against Samy Vellu on Dec 2 last year, seeking a court order that an investigation be conducted to ascertain his father’s mental fitness, and whether the former works minister has the capacity to manage himself and his matters.

Vell Paari sought an order that a date, time and place be set for an investigation to be conducted under Section 52 of the Mental Health Act 2001 on his father, to determine the period he had been suffering mental disorder.

He also sought a court order to find out if his father is capable of giving orders to his lawyer to act on his behalf and to determine the types of property his father owns.

In the event that Samy Vellu is found to be suffering from a mental disorder and incapable of managing himself and his affairs, Vell Paari wants several individuals including himself and lawyer C Vijaya Kumar to be appointed by the court as committee members to manage the defendant’s estate.

Vell Paari said that since 2017, he had assisted his father in managing his affairs and estate and had used his own funds for the purpose as his father could not have access to the funds from his bank accounts due to health reasons.
