
Judge Ghazali Cha, who allowed Nurshahira Mohd Mizuar’s application for a stay of sentence, said there was merit in her case.
“I agree with her counsel that her appeal will be futile by the time it is heard in the High Court,” he said.
Ghazali ordered Nursahira to post bail of RM5,000 with two sureties and to report to the Pendang police station once every fortnight pending disposal of her appeal.
Lawyer Naran Singh, who represented Nursahira, said her mother posted bail this afternoon to secure her freedom.
“She had been in a police-lock-up from March 27 and then sent to prison after she pleaded guilty to the charge in a Sessions Court,” he told FMT.
On March 31, Nursahira was sentenced to three months’ jail and fined RM10,000 or two months’ jail for making and initiating offensive communications on Facebook with intent to victimise others at a house in Persiaran Kiara Mas, Pendang, at 10.12pm on March 27.
She was charged under Section 233 (1) (a) of the Communications and Multimedia Act 1998 that carries a fine up to RM50,000 or a maximum jail term of one year or both upon conviction.
Naran said Nursahira was unrepresented when she pleaded guilty.
The Session Court on April 1 also refused to stay the sentence pending appeal and this led Naran to file a revision in the High Court.
Deputy Public Prosecutor Noor Azrul Abd Rahman objected to the application on grounds she had pleaded guilty to the charge.
