
A three-member bench led by Ummi Kalthum Abdul Majid unanimously dismissed the appeal by Aida Amira Harun to quash the jail sentence by the Alor Setar High Court last year.
Judges Yaacob Md Sam and Mohamad Zabidin Mohd Diah were the other members of the bench.
Yaacob said the court could not overlook the 31 injury marks on the victim, Ainul Solehah Mohd Husamuddin, then aged 2 years and eight months.
Amira had pleaded guilty at the Sungai Petani Sessions Court to a charge of causing the death of her daughter between 9.10pm and 9.40pm on Aug 10, 2016.
The court had sentenced her to three years’ jail and fined her RM3,000 or another one year imprisonment.
Following an appeal by the prosecution, the Alor Setar High Court sentenced Amira to 15 years’ jail.
Details during her trial reveal that Amira had rushed the child who was unconscious to a hospital in Sungai Petani.
A doctor then lodged a report following the child’s death. A post-mortem report revealed the child died due to duodenal perforation caused by a blunt force.
There were bruises on the victim’s abdomen and private parts while the intestines were ruptured.
Lawyer Matthews Jude submitted that the crime was committed because Amira was under stress.
However, deputy public prosecutor Nurshafini Mustapha told the bench that a psychological report had revealed that Amira’s mental state was only unstable after the incident.
“Even if she was stressed, the accused should not have vented her frustration on the defenceless child,” she said.
Amira has been in prison since Aug 11, 2016. Her two other children are under the care and custody of their grandfather.
