It said according to Section 2 of the Ministerial Functions Act 1969, once ministers and their deputies are chosen by the Yang di-Pertuan Agong, the government must gazette the king’s order which is known as the Ministers of Federal Government Order 2019.
“The date on which the order took effect must also be stated clearly in the gazette,” PAS secretary-general Takiyuddin Hassan said in a statement.
“The act of gazetting these appointments should not be taken lightly as it involves the legality of Cabinet members’ duties and the authority that they use.”
Minister in the Prime Minister’s Department Liew Vui Keong was earlier reported as saying that the positions of PH ministers have yet to be gazetted despite approval of the ministerial functions order by the chief secretary.
Takiyuddin said Liew, as minister in charge of legal affairs, should explain the matter to the people, along with the chief secretary who should have made the gazette and the attorney-general who is responsible for broadcasting it.
“Should they fail to provide a satisfactory explanation, they should take full responsibility and resign from their positions,” he added.
