PETALING JAYA:
Activist and graphic designer Fahmi Reza has sought to quash his conviction over an offence of uploading a caricature of Najib Razak.

His lawyer, Syahredzan Johan, confirmed they had filed an appeal to the Court of Appeal over the Ipoh High Court’s decision in November that affirmed a lower court’s finding that Fahmi was guilty under Section 233(1)(a) of the Communications and Multimedia Act (CMA).

The High Court also imposed a RM10,000 fine on Fahmi.

“We think he should not be convicted,” Syahredzan said.

It is understood that the prosecutors have also filed an appeal to enhance Fahmi’s sentence.

In February, the Ipoh Sessions Court sentenced Fahmi to one month in jail and fined him RM30,000 for the caricature that resembled a clown.

The jail sentence, however, was reduced to a RM10,000 fine after his appeal to the High Court.

Judicial Commissioner Mohd Radzi Harun had also advised Fahmi to use his talents “for noble causes and act as a role model for his followers on social media”.

On Oct 11, Fahmi was freed of another charge of posting a Najib-lookalike clown drawing in the Kuala Lumpur Sessions Court after the prosecutors said they did not want to proceed with the case.
