
The suit was over the stadium body’s alleged breach of land lease contract at Taman Sukan Extreme for the Karnival Stadium Bukit Jalil.
KL Karnival’s lawyer Adnan Seman said PSM filed the application yesterday on grounds that it is a statutory body incorporated under the Perbadanan Stadium Malaysia Act 2010 and therefore protected from any legal action under the act.
He said High Court Judicial Commissioner Wan Ahmad Farid Wan Salleh fixed Nov 26 to hear the application to strike out the suit.
Adnan spoke to the press today after attending the case management in the judicial commissioner’s room. Lawyers Muhammad Faisal Moideen and Priscilla Tan, representing PSM, were also present.
On July 5, KL Karnival, as the plaintiff, filed the suit through its managing director, Muhammed Rustam Roshandin, by naming PSM as the sole defendant.
In the statement of claim, KL Karnival claimed to have been awarded a land lease contract for a piece of land measuring 123,000 sq ft at Taman Sukan Extreme for three years until Dec 31, 2020, for the carnival. It had carried out earthworks which cost RM3 million.
However, they claimed that in January 2017, the defendant informed that a portion of the land given would be taken back, to be made into a parking space.
