Sivarasa freed of sedition charge

The Sessions Court gives the deputy minister an acquittal after AG's decision to withdraw the charge.

The Sessions Court today acquitted Sungai Buloh MP R Sivarasa of a sedition charge after the prosecution decided not to pursue the case.

Deputy public prosecutor Faizah Ismail said Attorney-General (AG) Tommy Thomas had decided to withdraw the charge after Sivarasa’s lawyers submitted a representation letter.

Lawyer N Surendran then applied for a discharge amounting to an acquittal since the charge had been withdrawn.

Sivarasa was acquitted by Sessions Court judge Gan Chee Keong.

Sivarasa, who is deputy rural development minister, was charged on Oct 20, 2015 with uttering seditious words against the judiciary.

The lawyer claimed trial to the charge related to a remark he had made at the #KitaLawan rally about former opposition leader Anwar Ibrahim’s imprisonment.

The 62-year-old was charged under Section 4 (1)(b) of the Sedition Act 1948 with the offence said to have been committed at the Kuala Lumpur City Centre compound on March 7, 2015.

Last month, Sivarasa was acquitted of two counts of abusing the internet to smear the image of former prime minister Najib Razak.

His lawyers had also sent a representation to the AG to withdraw the charges.

He was charged in April 2016 with two counts of posting on his Facebook account the month before a doctored Time magazine cover which featured Najib with the words “No. 2 on the most corrupt list”.

Sivarasa removed the post the same day after learning that it was a fake.

The said offence was punishable under Section 233 (1)(a) of the Communications and Multimedia Act with a fine not exceeding RM50,000, a jail term of up to a year, or both.

Sivarasa today told reporters the sedition charge against him was politically motivated.

“The previous Barisan Nasional government used the prosecution to file charges for criticising the judiciary,” he said, adding that he was relieved there were no more charges hanging over him.
