Ex-Selangor exco agrees to pay RM200,000 to Amanah’s Khalid for defamation

Khalid Samad had sued Hasan Ali in 2015 for implying he was a leader who had betrayed Islam.

KUALA LUMPUR:
A retrial of a defamation suit brought by Shah Alam MP Khalid Samad against former Selangor executive councillor Hasan Ali was called off today after Hasan agreed to pay RM200,000 in damages.

Khalid was also awarded another RM25,000 in costs.

The judgment was recorded in the High Court here before judicial commissioner Rohani Ismail.

“A retrial was scheduled to begin today. However, both parties agreed to settle the case amicably,” said Khalid’s lawyer Faiz Fadzil.

Khalid had sued Hasan in 2015 for implying he was a leader who had betrayed Islam. He said Hasan, a motivational speaker, defamed him during a talk he delivered at a Rukun Tetangga hall in Shah Alam on Jan 30, 2012.

Among others, Khalid said the words portrayed him as a leader who defended the sale of liquor and the existence of gambling centres and massage parlours in contradiction to Islamic principles.

Judge Hue Siew Kheng on Jan 27 last year ordered Hasan to pay RM200,000 in damages to Khalid and another RM35,000 in costs.

Hasan then did not make any submission when his counsel withdrew after the politician was disallowed from filing his defence.

The former PAS member had also not been able to engage a new counsel.

But early this year, the Court of Appeal ordered a retrial before a new judge after ruling Hue was wrong in striking out Hasan’s defence.

A three-member bench chaired by Tengku Maimun Tuan Mat set aside the striking out order and also quashed the finding of liability and award of damages.
