
He said his client, Dr Streram Sinnasamy, who was stopped from filing his nomination papers on Saturday, came to know about it following a reply from the EC yesterday.
On Monday, the PKR candidate had issued a deadline to the EC to include him as a candidate for the Rantau state seat. He had given the EC until Wednesday evening to comply with his request.
The lawyer said his client would now have to file an election petition within 21 days from the date the result was gazetted.
“It is very disheartening to note that the EC, which prides itself as the body to oversee just and fair elections in this country, just rode roughshod over the whole letter of demand sent by Streram.”
He said there was total silence to the various requests and clarifications sought in Streram’s letter to the EC.
Haniff said he had instructions from his client to file a suit for misfeasance in public office against the returning officer next week.
“We will be filing the election petition for breaches of Streram’s constitutional right to stand as a candidate as well as denying the rights of the Rantau constituents to have a choice to elect their state assemblyman.”
Streram was refused entry for not having a candidate pass issued by the EC. He was quoted as saying that he had not been informed about the need to collect the pass.
