Federal Court strikes out Anina’s suit against Najib

Court also allows the former Wanita Umno member's lawyer to discharge himself.

PUTRAJAYA: The Federal Court today struck out former Langkawi Wanita Umno member Anina Saadudin’s bid to reinstate her lawsuit against Prime Minister Najib Razak pertaining to 1Malaysia Development Bhd (1MDB).

Chief Justice Raus Sharif, who sat with Federal Court judges Balia Yusof Wahi and Aziah Ali, struck out her application for leave to appeal and also allowed her lawyer, Irzan Iswad, to discharge himself from representing her.

Anina was not present in court today but according to Irzan, who stood in for counsel Mohamed Haniff Khatri Abdulla, she did not object to his application to discharge himself.

Former prime minister Dr Mahathir Mohamad, former Batu Kawan Umno vice-chief Khairuddin and Anina sued Najib on March 23, 2016, accusing him of having committed misfeasance in public office and acting in breach of his fiduciary duty over the management of sovereign investment fund 1MDB.

On April 28 last year, the High Court allowed Najib’s application to strike out the suit, ruling that the prime minister was not a public official but a member of the administration.

On Aug 30, last year, the Court of Appeal dismissed the appeal brought by Mahathir, Khairuddin and Anina, prompting them to file an application for leave to appeal to the federal court.

On Feb 27 this year, at the Federal Court, a three-man panel led by Raus also dismissed Mahathir and Khairuddin’s application for leave to appeal.
