PPBM goes to court to stop RoS order

The High Court has fixed the leave application for judicial review to be heard on April 16.

PPBM has gone to court to challenge the provisional deregistration order issued by the Registrar of Societies (RoS) yesterday.

It has filed a judicial review application at the Kuala Lumpur High Court, seeking among others an order that the RoS declaration on the interim suspension of PPBM through a media statement is illegal.

It also wants the court to stop the RoS from taking any unlawful action that prevents the existence of PPBM as a valid political party.

The application was filed yesterday afternoon, soon after the RoS issued a letter to the PPBM secretariat and following the press conference announcing its decision to ground the party.

However, PPBM which is led by Dr Mahathir Mohamad, has to obtain leave from the court before the merit of its complaints can be heard.

According to court documents sighted by FMT, the leave application has been fixed before Kamaludin Md Said for 9am on April 16.

PPBM secretary-general Shahruddin Md Salleh, who is the applicant and has filed an affidavit in support of the action, named RoS director-general Surayati Ibrahim as the respondent.

Shahruddin is also seeking several declarations that PPBM had complied with all requirements and that he had a legitimate expectation that the RoS would not take drastic action such as threatening to dissolve his party.

He also wants a declaration that the RoS must give him the right to be heard before any action is taken to stop his party from participating in the general election.

Surayati had said PPBM would be deregistered if the party did not comply with the RoS’ requirements within 30 days.
