Rafizi seeks to set aside order resulting from defamation case

NFC chairman Salleh Ismail had obtained leave to cite him for contempt for allegedly defamatory articles still on Rafizi's blog.

KUALA LUMPUR: The High Court will hear a bid to set aside the leave granted to National Feedlot Corporation (NFC) and its chairman, Salleh Ismail, to initiate committal proceedings against Pandan MP Rafizi Ramli.

This is regarding some articles in Rafizi’s blog said to be in contempt of a judgement obtained in a defamation suit won by Salleh earlier.

Rafizi’s lawyer Razlan Hadri Zulkifli told reporters that Justice Nik Hasmat Nik Mohamed fixed Feb 23 for mention in chambers today.

“We came to know about Salleh obtaining the court’s leave last July when his lawyers served us the documents on the committal proceeding.

“We then filed our application to set aside the leave for committal proceeding in August,” he said.

Razlan said Salleh took contempt proceedings against Rafizi for allegedly breaching a court injunction in NFC’s defamation suit.

“They claimed that a few articles on Rafizi’s blog touching on the case fall under the terms of the injunction.

“We are saying that leave should not be granted and these articles are not covered under the injunction order,” he said.

It was alleged that Rafizi had not removed the articles on his blog related to the lawsuit.

Rafizi was ordered by the High Court, in October 2016, to pay RM200,000 in damages to NFC and Salleh, after he was found liable for defaming them.

The court also ordered Rafizi to pay costs of RM100,000 to Salleh and his company.

He sought public donations in July last year to pay the damages and costs. It was later reported that he had collected contributions of about RM1.5 million for the case.

Salleh had filed a bankruptcy notice against Rafizi for failing to pay RM300,000, with interest, to him and NFC.

The notice was dated July 13, 2017 and effected by an order dated Sept 12 the same year.

Rafizi claimed the bankruptcy notice published on the newspaper was intended to mar his reputation.

On September last year, he said through Facebook that he had settled the damages and costs.
