
Pandikar Amin Mulia said the suit must be annulled as it encroached into parliamentary privileges under Article 63 of the Federal Constitution and Standing Orders.
Article 63 states that the validity of any proceedings in either house of Parliament, or any committee, shall not be questioned in any court.
Lawyer Latheefa Koya, who appeared for the second-term MP, said Justice Kamaludin Md Said would hear the striking-out of the originating summons on Jan 8.
Government lawyer Sallehuddin Md Ali appeared for the speaker and Dewan Rakyat secretary Roosme Hamzah.
On Aug 2, Hee filed the lawsuit, naming Pandikar and Roosme as defendants for dismissing his questions related to the state investment fund.
Hee, who contested under the PKR ticket, is seeking a court declaration that Pandikar’s decision, made in his chambers, was null and void.
Hee had asked whether the government had raised any objection to the United States Department of Justice’s (DoJ) forfeiture suit.
He also wanted to know the whereabouts of businessman Low Taek Jho (Jho Low) as well as the status of Jho Low’s citizenship as he was alleged to have more than one.
Hee claimed Pandikar’s action in rejecting his questions on 1MDB had breached his constitutional rights and the right to free speech in the Dewan Rakyat.
Hee is the first MP to take legal action against Pandikar for rejecting questions in Parliament.
Opposition MPs had criticised Pandikar after he rejected more than 30 questions related to 1MDB in the last Dewan Rakyat session.
