
Lawyer Mohamed Haniff Khatri Abdulla said the case would be heard before justice Azizah Nawawi.
“An early hearing date was given as we had filed a certificate of urgency as the RCI is scheduled to start proceeding on Aug 21,” he said.
On Wednesday, Dr Mahathir filed a judicial review to quash the RCI’s refusal to remove Mohd Sidek Hassan and Saw Choo Boon from the tribunal.
In addition, Dr Mahathir asked that the five-member RCI panel be suspended from sitting pending the outcome of the court decision.
He named all the five RCI members, its secretary Yusof Ismail and the government as respondents.
In his application, the 92-year-old said Sidek and Saw were previously members of another task force that conducted a preliminary investigation into the losses suffered by the central bank in the 1990s.
On Tuesday, the RCI dismissed Dr Mahathir’s application to disqualify Sidek and Saw on grounds of bias.
The forex scandal occurred during Dr Mahathir’s tenure as prime minister.
The lawyer said his client’s application was important because the findings of a RCI could not be quashed, unlike criminal and civil cases.
Meanwhile, Haniff said a case management had been fixed on Aug 17 before justice Kamaludin Md Said on Dr Mahathir’s leave application to revoke Chief Justice Raus Sharif’s appointments.
Dr Mahathir wants an order of mandamus to direct Prime Miniser Najib Razak to advise the king to revoke Raus’ appointment as additional judge and chief justice.
In the application, Dr Mahathir said Raus should be barred from performing his judicial and administrative functions.
Raus had received his instrument of office and taken his oath of office as chief justice before the king on Aug 4,despite calls by the legal fraternity to reconsider the appointments.
