
Kum Eng Choon’s lawyer, Guok Ngek Seong, informed the Magistrate’s Court today that he tendered a notice of alibi to the prosecution, represented by Nur Farah Adilah Noordin.
“I hope the prosecution will investigate his alibi,” he said.
Magistrate Mahyuddin Mohamad Som fixed June 21 pending the outcome of the probe into the alibi presented.
Last month, Kum was charged under the Communications and Multimedia Act (CMA) for uploading the placard containing vulgarities against Najib and Rosmah.
He was also slapped with another charge under Section 505 of the Penal Code for making statements conducing to public mischief.
He was said to have committed the offence on April 4 morning at the Campbell Complex on Jalan Dangi Wangi here.
If found guilty under the CMA, he will face the maximum fine of RM50,000 or one year in jail, or both.
He could be jailed for up to two years, or pay a fine, or both, if convicted under Section 505.
Two days after he was charged, Kum lodged a police report denying he had uploaded the contents on April 5.
He claimed he was blocked by Facebook from March 30 to April 30 and denied he was at Campbell Complex to commit the said offence, as stated in his charges.
“The charges against me was based on a false report,” he alleged in the police report.
