Bersih to voters: Object if affected by latest redelineation

Electoral reform group says the Election Commission ignored objections raised by voters during the first exercise.

PETALING JAYA: Electoral reform group Bersih 2.0 is urging voters affected by the second round of the redelineation exercise to raise their objections with the Election Commission (EC).

The group’s treasurer Thomas Fann claimed that the EC had ignored voters’ objections on the first redelineation exercise held last year.

“It seems the EC has not addressed issues of having either too many or too few voters in a particular parliamentary or state seat,” he said at a press conference at Bersih’s office here.

He added that the commission had failed in its duties under the Federal Constitution to draw out boundaries for the constituencies.

“The number of voters should be equal in all the constituencies.”

He also asked why the EC had rushed the second round of the proposed redelineation exercise, to the extent of violating the law.

“Selangor was previously listed in the proposed exercise. But with the state’s legal challenge against the EC, it was left out in the second round of display,” he said.

Fann claimed the EC’s action was against the Federal Constitution as redelineation exercises must include all states in Malaysia.

The Selangor government filed a judicial review last year seeking to nullify the notice of redelineation by the EC in the state. The application argues the EC violated the Federal Constitution in drawing its new electoral boundaries for the redelineation exercise.

The Selangor government also wants a declaration that the notice was lacking in details and would cause voters, local authorities or the state government to be unable to exercise their constitutional right to file representations.

The Selangor government also wants the court to quash the EC’s notice and an order to direct it to publish a fresh notice on the proposed exercise.

It said the exercise violated Article 113(2) along with sections 2(c) and 2(d) of the Thirteenth Schedule of the Federal Constitution.

Bersih chief Maria Chin Abdullah, who was also present today, said the group was exploring possible legal challenges against the EC if the second round of the exercise was carried out.

Fann added that Bersih had prepared a set of template letters for voters affected by the proposed exercise.

“The voters can download from our website and just fill in their details in the template letters,” he said, adding that the deadline to submit objections was April 7.
