
Raja Syarafina said the RM500 in costs awarded to the PAS Information Chief in lieu of the cancellation of a defamation case had never been served to Lim nor any of his lawyers.
“Until today, the said RM500 was never claimed by Nasrudin’s lawyers.
“I hope to obtain a full explanation from his lawyers since Lim’s lawyers have not received any correspondence with regard to this matter.
“How is Lim to be ‘in contempt’ of court when there was no demand made in the first place?” Raja Syarafina said in a statement today.
Nasrudin yesterday brought up the issue of RM500 in costs awarded to him, after Raja Syarafina had earlier claimed that the Temerloh MP had still not paid a RM10,000 settlement to Lim, in accordance with a court order that was sent out on Sept 19.
She added that Nasrudin’s attempt to sidetrack the issue by saying the non-payment was “not contemptuous” was clear proof that he was not remorseful over his malicious allegations against Lim.
“By failing to pay the court the ordered costs, isn’t that disobedience? And without using legal terms, doesn’t that literally translate to contempt?
“… in this Internet age, with global communication, is it so difficult for Nasrudin to ask us for an extension for the payment?”
The RM10,000 order against Nasrudin was made after Lim had successully sued him for defamation over an article posted on Nasrudin’s Facebook account. However, Lim agreed to retract the suit after he apologised at the High Court in January.
Nasrudin had also said yesterday that he could not pay the amount as he was overseas and that he “had planned to pay the amount”.
Meanwhile, Raja Syarafina said Nasrudin had in fact owed Lim another RM2,000 in costs for his failed application to set aside the defamation case.
“The court had ordered Nasrudin to pay RM2,000 in costs as well, but Lim’s lawyers had yet to do so.
“This was after Nasrudin failed to set aside the case on April 20, 2015.
“Lim’s lawyers have been directed to make the claims for the RM2,000 to Nasrudin immediately. Rest assured that Lim will not get a sen from these payments as all would go to the lawyers,” Raja Syarafina added.
Meanwhile, Raja Syarafina reminded Nasrudin to pay up the RM10,000 owing to Lim immediately, as it has been more than three weeks beyond the due date.
“The due date was on Oct 2. A reminder was sent on Oct 7 and Nasrudin’s lawyers acknowledged receipt on Oct 11.
“Without any payment in sight, Nasrudin had instead chosen to attack me by releasing a press statement yesterday,” Raja Syarafina said.
