
Marry’s lawyer, Melissa Sasidaran, said the widow obtained default judgment at the High Court on Monday.
The four policemen, namely Inspector S Hare Krishnan, Sargent Jaffri Jaafar, and corporals Mohd Nahar Abd Rahman and Haswadi Zamri Shaari, failed to enter appearance.
“We served the summons in August and they were informed on the case management dates,” the lawyer said. “They were no show on Monday.”
Melissa said she would get instructions from Marry and family on assessment of damages.
Judicial Commissioner Roslan Abu Bakar fixed October 13 as the next case management date for Marry to reply to the remaining parties’ statement of defence.
The remaining parties are ACP Yahya Abd Rahman, Superintendent Glenn Anthony Sinappah, SAC Khairi Ahrasa, former Kuala Lumpur criminal investigation department chief Ku Chin Wah, Federal Police CID Director Mohmad Salleh, the Inspector-General of Police and the government.
Marry sued the police and government for damages over assault, battery, breach of duty, negligence, false imprisonment and conspiracies over her husband’s death in a police lockup.
She also wants a declaration that the police and government had recklessly, unlawfully and in bad faith, breached Dhamendran’s fundamental rights.
The High Court freed Hare Krishnan, Jaffri, Nahar, and Haswadi on June 29 from the charge of murdering Dhamendran in 2013.
The court ruled the defence had succeeded in raising reasonable doubt on the prosecution’s case.
