
“We will get a ‘process server’ to deliver to him,” said Ramkarpal Singh, the family’s lawyer.
The lawyer was denying a report that he will fly to Australia to personally serve a copy of court documents on Sirul. “I did not say so (flying to Australia),” he said.
Previous reports quoted Ramkarpal as saying a court officer had been roped in to expedite the legal process.
The lawyer had also tried last year to enlist the Foreign Ministry to serve the court papers on Sirul but it did not respond.
The Shah Alam High Court has fixed September 27 for case management.
Ramkarpal said the family has been “waiting too long” for the 10-year old conspiracy lawsuit to commence.
Altantuya’s father, Shaariibuu Setev, his wife Altantsetseg Sanjaa and two grandchildren, are suing the government, political analyst Abdul Razak Baginda, Sirul and Azilah Hadri, the other convicted killer, for RM100 million.
They have alleged conspiracy in the model’s murder.
The 2007 civil suit was postponed pending the disposal of the murder case at the High Court. Subsequently, there were appeals at the Court of Appeal and Federal Court.
Sirul and Azilah, both policemen, were convicted by the High Court in 2009 of killing Altantuya.
They succeeded in overturning their conviction at the appeals court in 2013.
The apex court restored their conviction last year and sentenced the duo to death.
Sirul did not show up for the final decision. The Federal Court issued a warrant of arrest for him.
Razak, who was charged with abettment in the murder of Altantuya, was freed at the end of the prosecution case. The court ruled the charge against him was not proven.
