Court rules Sedition Act cannot be ‘confined’ to some people

KUALA LUMPUR:
The High Court ruled that anyone can face a charge under the Sedition Act regardless of their career.

Judicial Commissioner Nordin Hassan, ruling to dismiss Padang Serai MP N Surendran’s bid to strike out his sedition charge, said that the court did not see the charge hinder his duties as a lawyer. “Anyone who breaks the law will face a charge, regardless of their role and status.”

“A charge under the Sedition Act cannot be confined to a specific group of people.”

JC Nordin added the sedition charge was based on valid law. “The prosecution has the duty to prove their charge against the accused and that can be done through a trial and the court’s duty is to carry out the laws.”

JC Nordin allowed an interim stay for Surendran pending his appeal on the dismissal of his striking out application. “The trial next Monday and Tuesday will be postponed for him to file his appeal. The next date will be July 20.”

Surendran was charged for sedition on August 28, 2014 for comments he made in a YouTube video on the Sodomy 2 case.

He was represented by Puravalen Raman and S Ambiga.

Wan Shaharuddin Wan Ladin appeared for the prosecution.
