Mohd Syahmi Afiq Salehuddin, 27, a former military intelligence officer; Mohd Readzuan Yaacop, 34, an online business operator, and Izzad Izzaidi Fuad Rosman, 28, a medical assistant at a hospital, pleaded not guilty after the charges were read to them separately before Judge Azrul Darus.
Mohd Syahmi Afiq and Mohd Readzuan had allegedly committed unnatural sex towards a man, 29, at a house on Jalan Mewah 1, Pandan Mewah, between 6am and 12.30pm on June 6.
The charge, under Section 377B of the Penal Code, provides for imprisonment of up to 20 years and whipping, if found guilty.
Izzad Izzaidi Fuad was charged with allegedly inserting his finger into the victim’s anus at the same location, time and date.
He was charged under Section 377CA of the Penal Code that provides imprisonment of up to a maximum of 20 years and whipping, if found guilty.
Deputy Public Prosecutor Goh Ai Rene did not offer any bail as the offence is under a section that cannot be bailed besides it is a serious offence.
“If bail is offered, the prosecution is concerned that the three accused will harass the victim and witness,” said Goh.
Mohd Syahmi Afiq and Mohd Readzuan, who were not represented by any counsel, requested that the court grant them bail as they had families to support and claimed that they did not know the victim well as they were introduced to each other through the WeChat application.
Counsel MK Thas represented Izzad Izzaidi Fuad who requested for bail from the court on grounds that he was still working for a government hospital and had a family to support with an income of RM3,000 a month.
Judge Azrul allowed a bail of RM10,000 for each of the accused with a guarantor, and an additional term which required them to report to the Ampang Police Station until the case is completed and they are prohibited from harassing the victim and the prosecution witness.
The court has set July 19 for remention of the case.
