Judge Irwan Suaibon held that based on the balance of probabilities, there were elements of negligence by Europe Cosmeceutical Industries Sdn Bhd in its beauty treatment carried out on Carol Frances Ward, 57.
The court ordered the company to pay RM80,000 in general damages, RM10,000 for pain and suffering, RM6,500 in reimbursement and other costs, including for accommodation and medical treatment at a private clinic.
In September 2014, the plaintiff sued the company, which operated a beauty centre in Jalan Kelawai.
In her statement of claim, she said she went to the beauty centre on Jan 19, 2013 to remove a deep wrinkle on her forehead.
She said based on the centre’s advice, she received an injection on her forehead.
However, following the procedure, a swelling appeared on her forehead which did not disappear and became worse and painful, and pus from it subsequently infected her right eye.
Carol said on March 20, 2013, she returned to Penang from Australia to seek an explanation from the beauty centre but this was not entertained.
She said she sought medical treatment at a private clinic but although the condition had healed, a scar remained on her forehead.
The plaintiff said the defendant failed to explain to her about the liquid that was injected into her forehead and risks involved.
Carol was represented by counsel Simon Murali while the company’s lawyer was Md Yusof Md Idris.
Md Yusof told reporters, when met outside the court, that the defendant would appeal against the decision.
