Lingam filed the appeal through an originating motion on Dec 15, 2015 at the High Court Registrar’s Office here through Messrs V K Lashmi & Co and named the Bar Council as the respondent.
Members of the media obtained the copy of the originating motion today and were informed that the case would be heard before High Court (Appellate and Special Powers) Judge Hanipah Farikullah on Oct 17.
In the originating motion, Lingam asked the court to set aside the board’s decision on Nov 6, 2015, in confirming the decision of its Disciplinary Committee that he had conspired with various parties to intervene or influence the appointment of judges.
Lingam also seeks to quash the Disciplinary Committee’s decision, through a report dated Feb 20, 2014, which found him guilty of interfering with or influencing the appointment of judges, namely in the appointment of Ahmad Fairuz Sheikh Abdul Halim as Chief Judge of Malaya and his confirmation as the President of the Court of Appeal at the time.
Lingam also seeks to set aside the committee’s decision in barring him from practising law for a year and imposing a fine of RM20,000 on him for the offence.
On May 20, 2008, the Royal Commission of Inquiry (RCI) made several recommendations over the video recording, which allegedly touched on the appointment of judges by Lingam and former Chief Justices Mohd Eusoff Chin and Ahmad Fairuz.
In their report, the five-member panel of the RCI concluded that the video clip was authentic, and that Lingam was the person in conversation with Ahmad Fairuz over the appointment of judges.
