
Penang state executive council Chow Kon Yeow said state PAS treasurer Iszuree Ibrahim served a draft copy of the Withdrawal of Appeal Notice to the state government’s lawyers today.
“We have been notified by our solicitors that Iszuree has withdrawn his appeal against the decision of High Court Justice Collin Sequerah on Dec 30 last year, dismissing his application for certiorari (a writ or order by which a higher court reviews a decision of a lower court),” Chow said in a statement today.
Iszuree was not available for comment.
Following a fallout with the Penang government leadership, Iszuree sought a judicial review on his termination as a Penang Island Municipal Council (MPPP) councillor and a member of three of its standing committees.
Iszuree was relieved of his duties after he was alleged to have publicly derided the Penang government leadership on housing matters at the annual PAS muktamar in Batu Pahat, Johor, in Sept 2014.
He sought a High Court order to nullify the state executive council decision on Sept 25, 2014 and MPPP’s letters dated Sept 26 and 29, 2014 to remove him from the MPPP committees, freeze his allocations and, stop him from attending any ad-hoc council meetings as well as meetings to discuss technical matters.
He named the state executive council, MPPP and the state government as respondents.
Following Iszuree’s application to nullify the decision, state secretary Farizan Darus issued a 48-hour ultimatum to the PAS man, via a letter dated November 21, 2014, to withdraw the suit or else face being sacked as an MPPP councillor.
When Iszuree refused, Farizan issued a termination letter dated Nov 29 to dismiss the PAS man as a councillor.
On January 9 this year, Iszuree filed another suit against his termination, naming the state’s executive council, secretary and government as respective respondents.
Iszuree said that his suit was personal and had nothing to do with his party. He also claimed to have been denied the right to be heard before the decision was taken to remove him from the council and the committees.
“I want to clear my reputation damaged by lies disseminated by certain quarters and, uphold natural justice and the rule of law,” Iszuree was reported as saying.
